The causalist current in bolivian legislation

The debate on the cause, incorporated as an essential element of validity of a contract based on the French Civil Code, has not been resolved in doctrine, taking into account that three currents have been generated around the subject: The causalist doctrine, the anti-causalist doctrine and the neocausalist doctrine. The issue has been transferred to the laws of countries which have assumed one position or another. In the case of Bolivian civil legislation, the bibliographic research leads us to the conclusion that the cause is not an essential element or the validity of the contract, a conclusion that is reached after the doctrinal and jurisprudential analysis and comparative legislation.
